2. SUBJECT

This contract regulates the rights and obligations of the parties regarding the sale and delivery of handmade products ordered by the BUYER from the SELLER's website www.odayhandmade.com, in accordance with applicable consumer protection laws and distance contracts regulations.

3. PRODUCT INFORMATION

The specifications, sales price, payment method, and delivery information of the ordered products are detailed in the order confirmation email sent to the BUYER.

Important Note: All our products are handmade. There may be slight variations in color tones, patterns, and dimensions compared to product photos. This is part of the handmade nature of the product and reflects the unique character of artisan craftsmanship.

4. GENERAL PROVISIONS

4.1. Order and Confirmation

By placing an order, the BUYER is deemed to have accepted the terms of this contract. After the order is placed, an order summary and contract information will be sent to the BUYER via email.

4.2. Price and Payment

Product prices are valid at the time of order and are stated in Turkish Lira (TRY), including VAT. International customers will see prices in their local currency at checkout. Payment is made through the method selected during order placement (credit card, PayPal, bank transfer, etc.).

All prices are final at the time of purchase. The SELLER reserves the right to modify prices at any time, but such changes will not affect orders already placed.

4.3. Delivery

Processing Time: 3-5 business days for handmade items (7-10 business days during peak periods such as Ramadan and holidays)
Shipping Time:
- Domestic (Turkey): 2-4 business days
- International (Europe): 5-10 business days
- International (North America): 7-15 business days
- International (Middle East): 5-12 business days
- International (Rest of World): 10-20 business days
Delivery Address: Address specified by BUYER during order placement

Shipping costs are calculated based on order amount, weight, and delivery destination. The BUYER is responsible for any customs duties, taxes, or fees imposed by their country for international orders.

If the product is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible for the recipient's refusal to accept delivery or any delays caused by incorrect address information.

Once shipped, a tracking number will be provided to the BUYER via email to monitor delivery progress.

5. RIGHT OF WITHDRAWAL

5.1. Withdrawal Period

The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the product to themselves or the person/organization at the specified address, without providing any reason.

5.2. Exercising the Right of Withdrawal

To exercise the right of withdrawal, the BUYER must notify the SELLER at [your email address] via email. The notification should include:

  • Order number
  • Product(s) to be returned
  • Reason for return (optional)

The product must be:

  • Unused and in its original condition
  • In original packaging with all tags intact
  • Undamaged and not altered in any way

5.3. Products Excluded from Right of Withdrawal

In accordance with consumer protection regulations, the right of withdrawal cannot be exercised for the following products:

  • Candles that have been burned or used
  • Custom-made or personalized products made to the BUYER's specifications
  • Products unsuitable for return due to hygiene or health protection reasons
  • Products that have been unsealed, used, or damaged after delivery
  • Sale or clearance items (unless defective or damaged)

5.4. Return Process and Refund

After receiving the withdrawal notification, the SELLER will provide the BUYER with return shipping instructions and the return address within 2 business days.

Return Shipping: The cost of return shipping is borne by the BUYER, unless the product is defective or damaged, in which case the SELLER will cover all return costs.

Refund Timeline: Once the returned product reaches the SELLER and is inspected to confirm it meets return conditions, the refund will be processed within 5-7 business days to the BUYER's original payment method.

Refund Amount: The full product price will be refunded. Original shipping costs are non-refundable except in cases of defective or incorrect items sent by the SELLER.

6. DEFECTIVE PRODUCTS AND WARRANTY

6.1. Reporting Defects

If the product is delivered damaged, defective, or incorrect, the BUYER must notify the SELLER within 48 hours of delivery. The notification should include:

  • Order number
  • Clear photos of the defect or damage
  • Description of the issue

6.2. Resolution

For defective or damaged products, the SELLER will, at their discretion:

  • Send a replacement product at no additional cost, or
  • Issue a full refund including original shipping costs

The SELLER will arrange and cover all costs for return shipping of defective items.

6.3. Product Quality

All products are handcrafted with care and inspected before shipping. Minor variations in handmade items (slight color differences, natural material variations, small imperfections) are not considered defects but rather characteristics of artisan craftsmanship.

7. PERSONAL DATA PROTECTION

The BUYER's personal data is collected and processed solely for the purposes of:

  • Order processing and fulfillment
  • Delivery and shipping
  • Customer service and communication
  • Legal and accounting obligations

Personal data is protected in accordance with applicable data protection laws and will not be shared with third parties except as necessary for order fulfillment (e.g., shipping carriers) or as required by law.

The BUYER has the right to access, correct, or request deletion of their personal data by contacting the SELLER.

8. FORCE MAJEURE

The SELLER shall not be held liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to: natural disasters, war, terrorism, labor disputes, government actions, pandemics, or failures of suppliers or shipping carriers.

9. LIMITATION OF LIABILITY

The SELLER's liability is limited to the purchase price of the product. The SELLER is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the products.

10. DISPUTE RESOLUTION

Any disputes arising from this contract shall be resolved in accordance with the laws of the Republic of Turkey. For Turkish consumers, consumer arbitration committees and consumer courts have jurisdiction in accordance with applicable monetary limits.

For international customers, disputes will be governed by the laws of Turkey, and parties agree to attempt good-faith resolution before pursuing legal action.

11. AMENDMENTS

The SELLER reserves the right to modify the terms of this contract at any time. Changes will be effective upon posting to the website. Orders placed before changes take effect will be governed by the terms in place at the time of order.

12. SEVERABILITY

If any provision of this contract is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. ENTIRE AGREEMENT

This contract, together with the order confirmation and any additional terms presented at checkout, constitutes the entire agreement between the parties regarding the purchase and sale of products.

14. EFFECTIVENESS

By placing an order, the BUYER acknowledges having read, understood, and agreed to all terms of this contract. The contract becomes effective upon order confirmation sent by the SELLER.
